Division of Compliance Management

Effective November 2020, the Division of Compliance Management (DCM) has reorganized within the Office of Management Assessment (OMA), forming four branches to continue to provide expert advice and guidance to diverse stakeholders across the NIH enterprise.

DCM

  • Leads, coordinates and implements NIH-wide requirements to promote legislative and policy compliance for the following program areas: Delegations of Authority, FAIR Act, Federal Register Notices, Forms, Information Management, Litigation Holds, reorganization management, Policy Manual, Privacy Policy, and Regulations;

  • Acts as the NIH focal point and liaison with the U.S Department of Health and Human Services, and other Federal agencies in the coordination of these requirements;

  • Provides training, advisory services, harmonization, standard operating procedures, and policy maintenance for the above program areas.

Procedures to pass down within NIH the formal assignment of legal power to make decisions and take actions (delegations)

In the DoA database ICO responsibility for decision making and expenditure of funds

Is responsible for oversight of the Federal Activities Inventory Reform (FAIR) Act at NIH, including:

Conducting the annual FAIR Act Inventory

Performance of post competition accountability

Guidance for Government’s Most Efficient Organization (MEO) expiration and transition

Oversight of Commercial Services Management

The Federal Register is the official journal of the federal government of the United States that contains government agency rules, proposed rules, and public notices.  It is published daily by the Office of the Federal Register (within the National Archives and Records Administration). The NIH Federal Register Program assist NIH staff in the preparation and submission of NIH notices for publication in the Federal Register.

Oversight and coordination of NIH-Wide Forms by:

  • Managing electronic and paper

  • Developing & approving new forms

  • Reviewing & revising existing forms

  • Updating and maintaining the forms website

  • Coordinating changes to forms with NIH staff

  • Providing annual updates to HHS of  cleared forms



FAIR Act image

Litigation Hold

                                                                                

Oversight and coordination of NIH-Wide document preservation related to civil litigation (litigation holds). This hold ensures that potentially relevant information in the possession, custody, or control of the NIH is preserved pending legal action when:

  • Civil litigation has commenced

  • Information suggests a credible probability of litigation

  • Circumstances could lead to a conclusion that litigation is reasonably anticipated

The NIH Policy Manual is comprised of individual Chapters (Manual Chapters) for the purpose of establishing NIH-wide policy in a central, easy to find location for the NIH community. A policy must be included in the NIH Policy Manual if it affects a significant number of people at NIH or outside the office issuing the policy. Contact the Program to develop new, or revise/rescind current, Manual Chapters.

Oversees the protection of the information NIH staff collect, store, and share by:

  • Determining where personally identifiable and sensitive information reside

  • Issuing trans-NIH policy and procedural documentation

  • Developing privacy awareness training and communications

  • Collaborating with multiple stakeholders to secure data and prevent privacy incidents
